Prep Your Practice for the 21st Century Cures Act

|

With an endless amount of information at our fingertips, it’s important for both patients and providers to have secure access to patient records when they need it. On May 20, 2020, the Office of the National Coordinator for Health Information Technology (ONC) gave the final ruling on the 21st Century Cures Act, directly impacting healthcare providers, patients, and health IT developers.

The new rule aims to give patients better, more meaningful access to their health records by eliminating information blocking—any activity or policy that is likely to interfere with access, exchange, or use of electronic health information, except as required by law or covered by one of the exceptions defined by the ONC.

The compliance date for the information blocking provisions are April 5, 2021, pending any additional updates by the ONC.

What does this mean for eyecare providers like you?

Upon request, you will need to give patients access to information within their electronic health record without charge. This includes access to the following:

  • Consultation notes
  • Discharge summary notes
  • History and physical
  • Imaging narratives/interpretation
  • Laboratory report narratives/interpretation
  • Pathology report narratives/interpretation
  • Procedure notes
  • Progress notes

If health care providers, health IT developers, exchanges, and networks refuse to comply they will face appropriate disincentives, as established by the ONC. However, there are permissible exceptions to the information blocking rules that can be found in the ONC Information Blocking Exceptions Fact Sheet.
